The Court of Justice of the European Union in Luxembourg, and previously the European Commission, leave no illusions. “Kasta” and its political allies will do everything they can to support Donald Tusk and his formation in the upcoming elections. Yesterday’s ruling by the Constitutional Tribunal and previous attacks by the European Commission against the Constitutional Tribunal and the National Judicial Council are a sign that there will be no mercy for Poland, ruled by the United Right camp.

It can be written that yesterday’s judgment of the Court of Justice violates the Polish Constitution, denies the jurisprudence of the Constitutional Tribunal (not only Polish), concerns the subject of the dispute, which has not existed for almost a year (the Disciplinary Chamber of the Supreme Court court has been liquidated) and is a clear violation of the treaties. It is all clear and a first-year student of Law and Public Administration can understand it. So much for rationality, because the rest is just politics.
Yesterday’s ECJ judgment is an important tool (for part of the opposition voters). Especially after Donald Tusk’s Sunday March. This is a reinforcement of his message and another intervention of the CJEU/EC a few months before the elections. Not the first and not the last. This is how it will look. First the street, and then tribunals foreign to us, will convince the Poles that they live in a weak, backward, isolated country, not legally handicapped. This is blatant nonsense, but as additional elements of the election campaign, these topics seem to carry some opposition. Everything should work in favor of the change of power in Warsaw. Are they legal bloopers? Who cares today!
The CJEU ruling and previous EC attacks on the Constitutional Tribunal and the register of the National Court are a sign that Poland will not receive money from KPO. Not now. Although the Disciplinary Chamber has been liquidated, an (extremely controversial) amendment to the Supreme Court Act has been prepared and submitted to the Constitutional Court, the government is seeking the favor of EU officials and what is the outcome? Nothing. There is no money anyway, the destruction of the Polish legal system continues and the hyenas from Brussels and Berlin watch this theater with increasing amusement.
We were right, so what?
And again, I should write that the army of politicians, judges, journalists (and myself, yours truly) were right, we knew this was how it would end. But what does it mean? Again nothing. This game will continue even if the United Right camp wins the election and forms a new government. If the balance of power in the European Parliament does not change, Poland will remain on the grid. Looking at the good results of the right in many elections in Europe, there is hope somewhere. However, it is worth considering another scenario: the opposition wins the elections in Poland and effectively forms a government. It is obvious that the European Commission will help the new government, which is (certainly) embroiled in an internal conflict. Only at what price? The “caste” will throw itself at the throat of honest judges who would not participate in its previous hucpa, the KRS, the Constitutional Tribunal and what is left of the Supreme Court will be destroyed. Vassalization to Berlin will mean a change of philosophy to Russia. The great support of Polish families, whose state today guarantees a solid basis for life, will be nullified. The Balcerowicze, Giertychy and Lisa return. Defense policy will also change. To the detriment of Poland, of course, and to the great satisfaction of Putin or his successors (including those whom the Kremlin regime imprisons today, and who themselves hate Poland and Ukraine, presenting ordinary Tsarist-Soviet imperialism). It will manage Poland together with the nomenklatura media, the rest will have to do. For years.
PS As I was finishing this column, the Supreme Court decided that the case of Ministers Wąsik and Kamiński. The case was referred back to the District Court for re-examination. This is a good summary of my words above. The highly politicized Supreme Court paid no heed to the Constitutional Tribunal’s ruling in this case. Oh, every day. After all, Supreme Court judges are “European judges”, loyal to the CJEU and Brussels. The rulings of the Constitutional Court do not apply to them.
