Announcement from the Ministry of Tourism and Tourism
The Ministry of Development and Technology has also issued a communiqué on the above-mentioned construction. Here’s the full text:
Stopping works at the construction site, application to the poviat construction supervision for repair procedures and an application to penalize the designer, as well as a notification to the Competition and Consumer Protection Office about the suspicion that the investor is using unfair practices towards customers – these are the main ones effects of the inspection on the construction site on Śródziemnomorska Street in Warsaw.
The apartment block in Mediterranean will be built right next to the villa project. It was possible because the capital’s authorities could not establish a local spatial development plan for many years, so developers worked with the so-called Wuzetki (Construction Conditions). The inspection revealed important shortcomings.
The inspection of the GUNB commissioned by me at the investment on Śródziemnomorska Street in Warsaw showed non-conformity with the previously approved design. We demand that the law be restored. We suspend construction and ask PINB Warszawa to start repair procedures. We are also reporting a case to the Office of Competition and Consumer Protection (UOKiK) on suspicion of using unfair practices towards customers

Inspection results
The deficiencies identified by the GUNB inspectors are the result of unauthorized changes to the approved structural design. This:
– Replacement of storage rooms in selected properties on the 2nd and 3rd floors for changing rooms.
– The change consists of the inclusion of spaces intended for storage units in residential buildings. The new rooms created in this way should be used for wardrobes and thus increase the living space. In addition, windows have been made that, if these spaces are used for residential purposes, do not meet the requirements of technical conditions with regard to sun protection (too little daylight).
– Change in the layout of the underground garage, as a result of which the usable area of the garage and associated infrastructure has increased to over 0.5 ha. Increasing the usable area of the garage to over 0.5 ha means that the construction of this garage is a project that can potentially have a significant impact on the environment. This implementation must be preceded by a statement from the regional director for environmental protection whether an environmental impact assessment is required. In addition, part of the storage areas have been converted into bicycle boxes.
– The inspection also found that 11 storage rooms located on the first floor have been converted into a one-room apartment. Further adjustments (connecting the installation, making windows and balcony doors) mean that this building can easily be adapted to a residential function and that there is not enough natural light. In the construction documentation of the building, this property is described as a “reserve room”.
You don’t have to be a construction expert to conclude that this investment is being made against the rules of common sense. But only the control GUNB showed the true extent of the irregularities. Therefore, construction must be stopped immediately by the Warsaw construction supervisor. We will also apply to penalize the designer – it is not allowed to change the character of the entrusted in such a significant way

Actions taken and planned
GUNB provided after the inspection:
1. Information to the president of UOKiK about the investor’s suspicion that he has used practices that infringe the collective interests of consumers, due to doubts that they have obtained reliable, truthful and complete information about the property.
2. Information on the results of the inspection, in particular the significant deviations found, to the PINB for the capital Warsaw, the authority competent to conduct proceedings at first instance, to take further action.
3. Information on the results of the inspection to the President of the capital Warsaw for use in possible future activities related to the building (for example, this authority may in the future conduct procedures to change the building permit or change the use of the building).
4. Information on the results of the inspection to RDEP, as the competent authority to determine whether an environmental impact assessment is required.
Such investments show the importance of the changes prepared by the Ministry of Agriculture and Tourism. The first is the reform of land use planning and development, which the Sejm is currently working on. The second is the regulation on technical conditions, ie counteracting the so-called stalemate developers. These solutions are expected and implemented out of concern for apartment and house buyers
