Project assumptions
According to the authors of the project, elements of sexual education of children and young people should be taught by qualified teaching staff, without the participation of external entities. The justification for the project states that “the exclusion of the possibility of conducting such activities in school, especially classes with students, should be of a general nature and not limited to this or that side of the public discourse”.
In addition, according to the draft, the parent council should regulate transparently how the parents of pupils are informed about the activities performed. The justification explains that project promoters do not impose “in advance” the method of regulating established communication practices.
The draft also proposes a system of “internal” oversight, where the principal gives binding permission for a community organization to operate on the grounds of a school or other facility. In accordance with the draft, an association or other organization intending to undertake activities in a school or institution shall provide to its director – in electronic and paper form – in particular: a description of the ongoing activity; implement goals and content in the school or institution; a description of the materials used to achieve these objectives.
The draft states that the director of a school or institution, immediately upon receipt of a notification from an association or organization, seeks advice from the school or institution council and the parents’ council, including the competent pedagogical supervisory body and the authority responsible for the school. or setting leads on the message. After obtaining the advice, the school director informs the parents about the advice. Lack of positive opinions means that the association or organizations cannot do business. Participation in such classes requires the written consent of the student’s parents, and in the case of an adult student – this student.
In addition, the draft stipulates that the advice of the school council and the parent council will not be required when organizing and giving lessons: in the context of assignments in the field of government administration; as part of the tasks of the National Center for Addiction Prevention; by a scouting organization under the honorary protectorate of the President of the Republic of Poland and operating in the territory of the Republic of Poland or by the Polish Red Cross operating in the territory of the Republic of Poland under the supervision of the Prime Minister.
The law must enter into force on September 1, 2023.
