Sanctions against foreign citizens who have not acquired Russian citizenship may be imposed because they pose a threat to the national security of the Russian Federation. This category includes:
– to speak for a drastic change in the foundations of the constitutional order of the Russian Federation;
– financing or planning terrorist (extremist) acts or assisting their commission;
– violation of public order and public safety (participation in unauthorized meetings, rallies, demonstrations, marches or strikes).
The decree states that, in accordance with the procedure established by law, decisions can be made against such citizens on expulsion from the country, readmission to the Russian Federation, administrative deportation from Russia, refusal to enter Russia, shortening the period. temporary stay, refusal to reside in Russia, deprivation of refugee status or temporary asylum and cancellation of residence permit.
If such a decision is made about a person, he must leave the territory of Russia within three calendar days from the date of notification, otherwise he will be deported.
According to the data of the Ministry of Internal Affairs, 691 thousand people received Russian citizenship in 2022. Of these, 296,000 Ukrainian citizens received Russian passports.
The decree also clarifies if, from September 30, 2022, residents of the DPR, LPR, Zaporozhye and Kherson regions have declared their desire to retain their citizenship, become stateless and a Russian citizen does not take the oath. Those who refuse to federate or receive will then be considered foreign citizens. According to the decree, they will be able to reside on the territory of the new territories until July 1, 2024, with the documents they have. It has been clarified that after this period such citizens will not be deported (as long as they do not take action to drastically change the constitutional order). It is also stated that people without Russian citizenship have the right to work on the territory of the new regions without a work permit, but the relevant authorities must establish their identity and enter the database.
The decree also defines the procedure for obtaining a residence permit in Russia, the period of consideration of the application should not exceed 20 working days.
