The Sejm of the Republic of Poland supports the creation of the Special Tribunal for the Crime of Aggression Against Ukraine, aimed at punishing the perpetrators of the crime; They should be prosecuted to demonstrate that international law does not allow for impunity, according to the draft resolution adopted by the Sejm Committee on Foreign Affairs.
Tribunal for the crime of aggression against Ukraine
The bill was introduced by a group of PiS delegates, and the foreign affairs committee gave its first readings at Wednesday’s meeting. The text was supported by all politicians who attended the committee meeting. Only stylistic and editorial corrections recommended by the Legislative Bureau have been made to the draft.
The head of the commission, Radosław Fogiel (PiS), stressed that the aim of the project is for the Polish parliament to call for the establishment of a special tribunal for crimes of aggression against Ukraine. He added that the discussion on this topic in the international space has been going on for a long time.
Of course, we have the International Criminal Court, which recently issued an arrest warrant for the leader of the Russian Federation, we have several international bodies that may be related to war crimes, crimes against humanity committed in Ukraine. But there is also the issue of the crime of aggression itself, here many countries, including Poland as one of the leading countries, are working to create such a special tribunal
Fogel explained.
Wojciech Gerwel, deputy head of the Ministry of Foreign Affairs, who attended the meeting of the committee, said that the Ministry of Foreign Affairs supports the draft resolution and the idea expressed therein.

What does the project entail?
The draft resolution of the Sejm on the establishment of the Special Tribunal for the Crime of Aggression against Ukraine states – taking into account the amendments – that “the armed attack by the Russian Federation against Ukraine is an act of aggression which, by its nature, is serious and size, constitutes a flagrant violation of the Charter of the United Nations and a form of criminal aggression.”
As we read further: “The Sejm of the Republic of Poland supports the establishment of the Special Tribunal for the Crime of Aggression against Ukraine, aimed at punishing the perpetrators of the crime, and also points out that for the effective prosecution of this kind of international crime, it is necessary to properly secure the evidence. It therefore supports initiatives in this regard, in particular the establishment of the International Center for the Prosecution of Crimes of Aggression against Ukraine.
The Sejm of the Republic of Poland, as the draft further states, “emphasizes that the prosecution of the perpetrators of international crimes committed in and against Ukraine, especially the crime of aggression, is necessary to demonstrate that impunity is not allowed.” under international law and that individual criminal responsibility may also be borne by heads of state”.
