Judge Łukasz Piebiak, who was a guest on wPolsce.pl today, critically assessed the bizarre decision of the Supreme Court, which ruled in one of the cases that Judge Przemysław W. Radzik could not be considered “impartial and independent”. The former deputy justice minister agreed that the “independence test” allegedly failed by Judge Radzik is in fact part of the “caste” war with the judiciary, which could lead to chaos throughout the country. legal system.

I read the case as a simple consequence of omissions burdening the political class, I will not mention the name. (…). As a result, some judges felt unpunished. Those judges who tend to rebel against their peers and the system have seen that the disciplinary system does not work. The fish rots from the head down, so this tendency is most apparent in the Supreme Court. Judge Matras (he ruled on Judge Przemysław W. Radzik and gave an interview to “Rzeczpospolita” – ed.) gave an interview about the case in which he ruled himself – that also raises some doubts. Judge Matras spoke of “transgressions” allegedly committed by Judge Radzik. To the extent that certain circumstances surrounding Judge Matras were covered in the media, he also soon found himself in the Supreme Court, given the circumstances of the Polish judiciary. You can say somewhat ironically that a man “knows his stuff”. (…)
Judge Łukasz Piebiak said that today.
It is necessary to deny the reality created by the “Iustitia” association and its political friends that it is “judges close to the authorities who lie in wait for civil rights and try to destroy”. In fact, it is “Iustitia” and opposition politicians who are doing everything they can to intimidate the judges. They know very well, and I hope the authorities know too, that if there are no people in the judiciary willing to restore the judiciary, no political party will reform it. That’s what politicians are for, to listen to citizens’ expectations, but they also need people in a certain environment to help make these changes happen
– emphasized Judge Łukasz Piebiak.
Just as health reform will fail without the cooperation of physicians, changes in the judiciary will fail without the cooperation of judges. I think the aim is to frighten thousands of judges who are in favor of judicial reform (…).
– added the former Deputy Minister of Justice.
