A Supreme Court hearing began behind closed doors on Thursday on the immunity of prosecutor Ewa Wrzosek, whom detectives want to accuse of providing information from the investigation to unauthorized persons. The next hearing on the case is scheduled for May 18.
Prosecutor Wrzosek case adjourned
The case is being heard by a one-person panel of the Supreme Court’s Professional Liability Chamber. However, at the request of the Szczecin Prosecutor’s Office, Judge Zbigniew Korzeniowski closed the hearing to the public. Neither journalists nor the public can observe the case.
The public prosecutor appeared in the Supreme Court on Thursday together with three defenders. After a trial of less than two hours, the case was adjourned.
The next date is May 18 at 9 a.m
– announced Prosecutor Wrzosek after leaving the courtroom.
I learned today that part of the prosecution’s request that my immunity be waived is also classified. I did not have access to this part, so we will file an application with the court to familiarize ourselves with these materials
said Wrzosek.
She added that the public prosecutor’s office opposes and does not agree to provide her with the secret part of the application.
“In my opinion, the evidence has been manipulated.”
Even before the start of Thursday’s meeting, prosecutor Wrzosek stated that the prosecutor’s office has – in her opinion – illegally obtained the evidence in this case with the help of the Pegasus program.
The evidence has been manipulated in my opinion and I hope to prove it in court. The request to waive my immunity contains a number of formal, substantive and legal errors. Unfortunately, I did not receive all the material submitted by the Szczecin Prosecutor’s Office with this application. However, the material made available to me does not provide a shred of evidence for the accusations that the public prosecutor’s office has made to me publicly in a press release.
said Wrzosek.
Motion to waive the immunity of the prosecutor in early December last year The regional prosecutor’s office in Szczecin referred the case to the Supreme Court. At the same time, this prosecutor’s office sent a request to hold another Warsaw prosecutor, Małgorzata M., accountable for political activities. Both prosecutors were suspended for six months, Małgorzata M. was also dismissed from the position of Deputy Prosecutor for Warsaw-Żoliborz.
According to the prosecutor’s office, the background to these allegations is the presidential campaign in 2020 and two bus accidents in Warsaw that occurred at the time. The first happened at the bridge. Cave-Roweckiego, one person has died. The bus driver was subsequently charged with driving under the influence. According to the prosecutor’s office, Michał D., who acts as director of the Security and Crisis Management Office of the City of Warsaw Warsaw, using his acquaintance with Prosecutor Wrzosek, was supposed to expect that the detective would inform him about the findings of the accident procedure.
The public prosecutor’s office then also made public fragments of electronic correspondence between the prosecutors and the official. According to the Szczecin prosecutor’s office, Wrzosek – who has no direct access to the case – obtained information about the proceedings from her friend, prosecutor M. and passed it on to Michał D.
“I will not be intimidated, even if I am handcuffed.”
Prosecutor Wrzosek denied the content published by the Szczecin prosecutor’s office.
This is no longer just an attempt at harassment. This is an attempt to remove me from public opinion and to silence me so that I do not criticize Zbigniew Ziobro’s prosecutor’s office. (…) I will not be intimidated, even if I am handcuffed
she stressed.
She added that her phone was being monitored using the Pegasus system, which allows manipulation of the contents of electronic devices.
At the end of September last year, Wrzosek reported that the Warsaw District Court had ordered the public prosecutor’s office to investigate the suspicion of tapping her phone. Previously, the Warsaw District Prosecutor’s Office refused to initiate proceedings in this case. The case was brought by Wrzosek, who reported to the prosecutor’s office about a possible cyber attack on her phone, which would be subject to the Pegasus system.
