Judge Łukasz Piebiak was questioned about the actions of Judge Piotr Gąciarek, who repeatedly issues orders challenging the rulings of other judges – nominated by the current composition of the National Judicial Council.
It’s hard to even understand here. It is not for such cases that Article 439 of the Code of Criminal Procedure was created by the legislator. From this article, justice activists of “Iustitia” and “Themis” have made such a bag in which they put all their frustrations and political manifestations. They give vent to it through their resolutions

This has nothing to do with the absolute grounds of appeal referred to in this provision. These can of course appear and the criminal and civil procedure has these kinds of shortcomings, which should lead to withdrawal. What kind of “gross misconduct” are we dealing with here? Except we have a president who dislikes someone and we question his privilege? Or maybe someone dislikes the National Judicial Council for political reasons? That is why they want to question all procedural decisions of judges in whose appointment process the National Judicial Council has participated?

It is clear that we are not dealing with the law, but with the actions of politicians in gowns and with an eagle on their chest. This is worth stigmatizing. (…). They are capable of such things. These people are jeopardizing the justice system. Their antics influence the perception of the work of 10,000 mostly honest and hard-working judges. (…)

Judges are supposed to be legalists
The former State Secretary for Justice points to the lack of consequences that judges should bear. The dismantling of the disciplinary jurisdiction is to blame for this.
This system, the National Court Register, has been in existence for several years and has been constitutionally reviewed by the Constitutional Tribunal. There is no other system. (…). A judge, regardless of his personal views, cannot choose the system of judicial appointments. He is involved in legal proceedings. (…). Judges should be legalists and it is not for them to replace the legislature and they cannot set a political direction. This is what society expects of them, predictability of behavior. (…). The average citizen should know what to expect in court
