“The law specifying the term of office of the President of the Constitutional Court entered into force after the appointment of Julia Przyłębska. I can only appeal to the six judges of the Constitutional Court to refrain from their destructive behavior. The point is to end this case as soon as possible,” MEP Zdzisław Krasnodębski said on RMF FM radio, referring to the situation in the Constitutional Tribunal.
The issue of the term of office of the President of the Constitutional Tribunal has been resolved
The General Assembly of the Judges of the Constitutional Tribunal has adopted, by an absolute majority, in the presence of two-thirds of the Judges of the Constitutional Tribunal, a resolution stating that there is no need to convene an assembly to to select candidates for the president of the Tribunal, said Aleksandra Wójcik, spokeswoman for the Constitutional Tribunal.
As she reported, the General Assembly of the Judges of the Constitutional Tribunal was convened by the President of the Constitutional Tribunal, Julia Przyłębska “pursuant to art. 7 sec. 2 of the Law of 30 November 2016 on the organization and procedure for the Constitutional Court”.
The subject of the hearing was a letter dated 28 February from six judges of the Constitutional Court. calling again for the General Assembly of Judges of the Constitutional Tribunal to be convened to select candidates for the post of President of the Constitutional Tribunal
she inquired.
The wPolityce.pl portal learned the contents of the reply from the President of the Constitutional Court, Julia Przyłębska, to the letter from Judge Jakub Stelina, who questioned the term of office of the President of the Tribunal in January. According to Judge Stelina, Judge Julia Przyłębska ended her term in office in December last year. The president of the Constitutional Tribunal stressed that she was in office until “the date on which the term of office expires”.

Is the President of the Constitutional Court considering resigning?
prof. was asked about the case on RMF FM radio. Zdzislaw Krasnodebski. The PiS MEP pointed out that the conflict in the Constitutional Tribunal “is due to the introduction of a new law specifying the term of office of the president of the Constitutional Tribunal”.
There are expert opinions – most say that since the law came out later, it does not apply to the president. There are so and so
said the MEP.
He also called on the judges of the Constitutional Court to “give up their destructive behavior” as this affects the issue of the full composition of the Constitutional Court to decide whether the amendment to the law on the Supreme Court is constitutional is.
The law specifying the term of office of the President of the Constitutional Court entered into force after the appointment of Julia Przyłębska. I can only appeal to the six judges of the Constitutional Court to refrain from their destructive behavior. It’s about getting this over with as soon as possible
added Prof. Krasnodębski.
I am not a judge of the Court. In my opinion, we must take into account a certain overriding interest of our country. Unfortunately, in Poland it is very common for personal interests to prevail over overriding interests. Now it’s time to get this thing over with quickly
– said the politician, who called on the judges of the Constitutional Tribunal “to take into account the interests of the Republic of Poland”.
When asked if the president, Julia Przyłębska, is considering resignation, Prof. Krasnodębski replied that the president of the Constitutional Court “takes into account the interests of the state”.
I don’t know if Julia Przyłębska is considering resignation. I think that each of us reflects on our social function
– noted Prof. Krasnodębski.
Coalition with Solidarna Polska
The conversation was also about the cooperation between Law and Justice and Solidarna Polska.
There are several things after eight years of government and you really have to think very seriously about whether some people should be on the Law and Justice lists.
said Prof. Krasnodębski, explaining that he meant people who “did not behave in a way that aroused the approval of everyone in society”.
Solidarna Polska is a coalition partner, has a different opinion – more radical on many points, moreover – Solidarna Polska was also responsible for the reform of the judiciary. Which we wouldn’t say – it’s not very successful
– the MEP judged, admitting that he very much appreciates some of the SP’s colleagues, but the party could go to the elections “separately”.
referendum on abortion
The MEP was also asked about the abortion referendum. The head of PSL, Władysław Kosiniak-Kamysz, and Poland 2050 leader, Szymon Hołownia, presented on Wednesday a list of issues to be addressed in the next legislature regarding the participation of both groups in the future government. The first 100 days include: restoring legal status regarding the possibility of abortion to the state before the October 2020 Constitutional Tribunal ruling and holding a referendum on this issue. Prof. Krasnodębski said such issues are not matters for a referendum.
I would – this is sarcasm of course – link abortion to the issue of euthanasia, which is becoming more and more common. Why only abortion? Also, I would especially like to request euthanasia from those who are waiting for the legacy of their elderly relatives
said Prof. Krasnodębski.
When asked about the position of the Civic Platform and the Left regarding the liberalization of the right to abortion, the politician said that the subject of euthanasia would be discussed shortly.
I am convinced that in 10 years we will say the same about euthanasia. Opinions are opinions, but there is also the issue of human dignity. I realize that when it comes to the protection of unborn life, there is also a conflict of values, self-definition, it is not an easy thing – said MEP Zdzisław Krasnodębski.
