The liberalization of the windmill law goes against PiS’s 2015 and 2019 program assumptions, Paweł Sałek, an adviser to President Andrzej Duda, said at the PAP Studio on Friday.
At the beginning of February, the Sejm abolished the so-called distance law, which assumes that wind turbines can be built at least 700 meters away from homes, provided that a number of additional conditions are met. The senate proposed on Wednesday to reduce the minimum distance from 700 to 500 m and allowed the further reduction with the consent of residents and the municipality. According to Paweł Sałek, the opposition has set a trap for the United Right on this issue.
It was promised that the opposition would vote in favor of the bill. In the end, she abstained and all political responsibility as to what this law will look like will fall on PiS

According to him, the provisions proposed by the government will provoke protests from the villagers and negatively affect the results of the party in the upcoming elections.
The argument today is that there are no protests in the countryside related to the construction of windmills, well, because these windmills are built completely differently than in 2013 or 2014, but if investors go back to the countryside, the protests will start again

At the same time, he expressed doubts whether the amendment of the provisions of the Wind Farm Act would affect the release of money from the KPO for Poland.

When asked if he would recommend President Andrzej Duda sign the amendment to the Wind Farm Act if the Senate amendments are rejected, he said it is difficult to comment on this issue at the moment.

Principles of the law at a distance
The 2016 amendment to the law stipulates that new wind turbines may only be installed on the basis of the Local Spatial Development Plan (BRP). The basis for determining the minimum distance – between 10 times the maximum height of the turbine (rule 10H) and 700 m for residential buildings – will eg be results of the strategic environmental impact assessment (SEA) carried out within the framework of the MPZP. Among other things, the SEA analyzes: the impact of noise emissions on the environment and the health of residents. The municipal council will not be able to withdraw from the EIA plan for the LZP project, which includes a wind farm.
The law also introduces minimum distances between wind turbines and power transmission lines. At the same time, the ban on building homes near existing wind turbines will be completely lifted.
The new law maintains the 10H principle for national parks and the 500 m limit for nature reserves. For other forms of nature protection, the distance must arise from the environmental decree for a specific area. installation. It enforces the ban on building windmills in national parks, nature reserves, landscape parks and Natura 2000 areas.
In addition, the new legislation stipulates that the investor will offer a minimum of 10 percent. installed capacity of the wind farm to the inhabitants of the municipality who would use electricity as a virtual prosumer. Each resident of this municipality can take a share of up to 2 kW and receive electricity at the price resulting from the calculation of the maximum construction costs.
The amendment to the Distance Act is one of 37 milestones Poland must meet in order to meet the requirements of the Recovery and Resilience Facility and receive funding from the National Recovery Plan.
