“It is tragic and sad from the point of view of the EP that the request to waive our immunity empowers a criminal,” MEP Tomasz Poręba (PiS) told PAP in reference to the request for the immunity of four PiS members from to repeal the EP.
On Monday, the EP will consider the court’s request to lift the immunity of PiS members: Tomasz Poręba, Beata Mazurek, Patryk Jaki and Beata Kempa. This is the result of the indictment filed by activist Rafał Gaweł – the founder of the Observatory on Racist and Xenophobic Behavior – for the PiS warning against the PO’s migration policy. According to unofficial information from PAP, the matter will be referred by the EP to the legal committee on Monday.
Gaweł accused PiS politicians of violating Art. 256 of the Penal Code, which states, among other things: about incitement to hatred. He accused both the makers and the politicians who shared the election spot.

TVP Info reported in early February that Gaweł “is a criminal who, even during the PO’s rule, heard a number of allegations of financial embezzlement, was convicted by the court, and after the verdict was passed, left the country and is still wanted by the police.”
From the point of view of the EP, it is tragic and sad that the request for our immunity to be waived empowers a criminal. Moreover, he is doing it today, after holding the case for a year and a half, clearly participating in the election campaign that is starting in Poland. It is no secret that I am responsible for running the ruling party’s campaign. This is an attempt at harassment. On the other hand, the behavior of the Polish court, which recognized the person prosecuted by the arrest warrant as credible and involved him in the case, shows how politicized the judiciary is today, often violating all rules of law and decency
Poreba told PAP.
“As you can see, it’s nothing more than a hoax.”
PAP also received the letter from MEP Prof. Ryszard Legutko (PiS) to MEPs on this issue.
In it, Legutko indicates that Gaweł is a person “sentenced by a final verdict to absolute imprisonment and for fraud, and is currently hiding outside the European Union because he is wanted by an arrest warrant.” As he adds, “therefore, he’s a completely unreliable character because of his criminal past.”
In the letter, the MEP also notes that “it is no coincidence that the whole defamation scandal just broke out” and that “it is about defaming politicians who hate politicians and make it difficult for them to keep their mandate and have a election campaign.”
As you can see, this is nothing more than a hoax, with the sole purpose of harming the activities of our colleagues as Members of the European Parliament. Liking and retweeting the election spot was an expression of freedom of expression and part of the political debate. It is unprecedented that the European Parliament gives de facto consent to the waiver of immunity procedure. Moreover, all this is happening at a time when the election campaign in Poland has just begun, and one of the individuals attacked is the head of the ruling party’s election campaign. This is happening now, even though the problem has been known for years. This attack is thus clearly baseless and politically motivated
