I think this is not a situation where money is at risk – said Senate Deputy Speaker Marek Pęk (PiS) in the context of the president’s decision to submit an amendment to the law on the Supreme Court to the Constitutional Court, which, according to the authors, is fulfilling one of the most important “milestones” related to KPO.
Amendment of the law on the Supreme Court addressed to the Constitutional Court
On Friday night, President Andrzej Duda announced that he had referred the amendment to the Supreme Court law to the Constitutional Tribunal.
The amendment to the Supreme Court law, the draft of which was tabled by PiS deputies, should represent an important “milestone” for the European Commission to release funds for the national reconstruction plan. It states, among other things, that disciplinary and immunity cases of judges should be settled by the Supreme Administrative Court, and not – as is currently the case – by the Professional Liability Chamber of the Supreme Court. The amendment also provides for fundamental changes with regard to the so-called review of judicial independence and impartiality.

– Pęk replied on RMF FM radio to the comment that there will be no money for KPO until there is an amendment of the Supreme Court law.
It’s not like there won’t be a law. The Constitutional Tribunal will meet, analyze the case, it has the right tools (…) so I wouldn’t be afraid here

A political dispute
He noted that “the president exercised his prerogative” and “that’s hard to argue with.” The PiS politician pointed out that the procedure regarding the funds for KPO will be postponed and that the opposition “thunders” over the defeat, saying that “the opposition is thundering, but has been doing everything for years to avoid this money”.
He also judged that “the question of a few days or a few weeks is not crucial”.
As the president said in his speech yesterday, it’s not like he signs the bill and the money goes right in. It is a complex system of all kinds of administrative, financial and political activities. But let us not be under any illusions either, this dispute between Poland and the European Commission, the European Union, is primarily of a political nature and it is above all necessary to work with the European Commission

As part of the responsibility for the fact that there is still no money for KPO, he stated that the situation is not “black and white, zero-one” and that “it is difficult to talk about who is to blame and who not guilty”. According to him, the current situation is due to “the specific nature of all these decisions” and if you could “only have a dispute of a legal nature, the conversation would be very different”.
When asked if the president was guilty, the PiS senator replied that it was not the president’s fault.
The president has his own particular political and legal sensitivities, he is entitled to his own opinion on these matters. It is also no secret in the fold of the United Right, we also argue about it. The vision of Law and Justice is different from that of Solidarna Polska

Amendment of the Electoral Act
Senator Pęk was also asked about the amendment to the electoral law passed in the Sejm two weeks ago, which will now be considered by the Senate.
It is necessary to adopt changes that are not, as the opposition says, particularly controversial, they are primarily pro-turnout, they support the will of the sovereign to be expressed in the widest possible way in the elections
– he said.
According to him, in connection with the changes to the Electoral Act in the Upper House, “there will be a story about the fact that these changes are unacceptable from the point of view of the date they are implemented, that the elections are close”.
Then we will have to remember 2011, when the whole Electoral Act was passed in the election year, and therefore a much broader and deeper law than the amendment we are making
– he said. He added that “without regard to the Sejm compromise”, single-mandate constituencies were introduced in the Senate elections.
The amendment to the electoral law adopted by the Sejm provides for the obligation of the self-government of a municipality where there is no public transport to provide free transport to the polling station. The permanent constituency should go from 200 inhabitants (instead of 500 as it is now) to 4000 inhabitants. The amendment was opposed by the opposition; KO accused the project of not aiming to increase voter turnout, but PiS’s electoral chances.
There is no alternative to the United Right
The conversation also touched on the issue of turbulence in the United Right. Sejm Vice-President Ryszard Terlecki said he wants Solidarna Polska’s candidates removed from United Right lists.
The United Right alternative is Donald Tusk, Radoslaw Sikorski, Roman Giertych, Borys Budka. So there is no alternative. Marshal Terlecki is clearly one of the PiS leaders, while coalition decisions are made by the PiS leadership. Regardless of the tensions between us, I see no alternative
– said Marek Pęk, adding that if Solidarna Polska had started from the beginning with a strong anti-European agenda, it would never have made it to the Sejm. The senator pointed out that the goal of the United Right in the upcoming election is to break the opposition’s Senate pact.
Sikorski’s money from the UAE
When asked about Radosław Sikorski’s political future, the senator expressed the hope that this future would be black.
This means that finally someone, also in the Civic Platform, will draw conclusions from what this man says, how this man functions politically. Because regardless of the things that have come out lately, i.e. the huge money he is raising from the United Arab Emirates, this is a man who, even at this critical moment of the ongoing war, with his statements is simply the Polish raison d’être. ‘état harms, harms Poland. And if he is not an image burden for Donald Tusk, for the Civic Platform, it means that this environment is not at all concerned about moral standards, but also about the Polish raison d’état
