“The opposition has created an unconstitutional law,” writes Prof. Wojciech Sadurski. According to the lawyer, the opposition groups have “collapsed” and “paralyzed themselves politically”.
“And what would PiS and TVP say…”
The amendment of the law on the Supreme Court, which – according to the Minister of European Affairs Szymon Szynkowski vel Sęk, unofficial reports from correspondents of RMF FM and Polish Radio in Brussels – has been positively received by the European Commission and brings us closer to receiving money from the KPO, according to Prof. Sadurski, is unconstitutional, and the opposition “have done nothing to block it.”
According to the author of the text in “GW”, the unconstitutionality of the passed law “is not up for discussion in serious society.”
Why did the opposition not block the bill? In the opinion of Prof. Sadurski – she was just afraid of PiS and TVP.
The dominant argument of the opposition politicians themselves boils down to the question: what would PiS and TVP say if we blocked large EU funds for Poland?
notes the lawyer.
According to Sadurski, such an argument is naive.
First of all: whatever you do, PiS and TVP will turn you into Germans, Muscovites, traitors and thieves. So it’s not worth being afraid of TVP comics
– we read in “GW”.
What “consolation” does Prof. Sadurski say?
Wojciech Sadurski argues that society can be explained why it voted against an unconstitutional law.
Postponing the receipt of this money for a few months – until the elections – will pay off for the Poles
says the lawyer. He only forgot that the opposition politicians, who could only benefit from this delay, are only a certain part of Poland as a whole.
Therefore, one should not succumb to the blackmail of opponents and commit political self-paralysis. On the contrary: it is worth fighting populists with their heads held high, even in potentially “unpopular” matters. Just like Joe Biden did in his State of the Union address: without hesitation or fear of what the right wing would write about him, he clearly stated his views on things like reproductive rights or restricting access to guns
Sadurski writes.
The consequence of the collapse is that the power to decide on the adoption of an unconstitutional law in Poland is given to Andrzej Duda – one of the main culprits of the dismantling of the Polish constitutional system.
— the law professor probably missed that Andrzej Duda is the president and it is normal for him to decide on the passing of the law.
The only consolation is this: it is not at all said that this jute law will convince the EU decision-makers who will pass this game
Sadurski emphasizes. Could this be his way of suggesting to the opposition how else to “fight the populists”? And is the thought of further blocking money intended for Poland, and not PiS, PO, the Left or the Confederation, really “comfort” for him?
I wonder if the statement of a simple fact: that money is needed from KPO as soon as possible, is also populism for Sadurski.
