President Andrzej Duda observes the work to amend the Supreme Court law. We’ll see how it comes out of parliament. Then the president will make decisions – said the head of BPM Marcin Przydacz on Tuesday. He assured that the contacts between the president and the government on this matter are very intensive.
The Senate dealt with the amendment of the Supreme Court Act. On Monday, the Senate Human Rights, Rule of Law, Petitions and Legislative Committees voted in favor of the amendment, along with 14 amendments proposed by the Senate majority.
President in Latvia
The head of the President’s Office of International Policy was asked whether consultations between the President and the government on this issue are ongoing and whether Andrzej Duda is now closer to a decision on the amendment Marcin Przydacz.
At the moment we are focusing on the visit to Latvia and in Latvia it will be difficult to talk to the Polish government about the future of KPO
– replied the minister, referring to Andrzej Duda’s multi-day visit to Riga from Tuesday.
Przydacz also stressed that the president was overseeing work on the amendment.
After all, we know that the bill (…) is currently in the hands of the Senate
– he said.
We will see in what form this bill will come out of the Senate and consequently in what form it will come out of the Polish Sejm, then the president will make decisions
– noted the presidential minister.
However, I can assure you that contacts between the President, the President’s Chancellery and the Government here are very intensive and these talks are still ongoing.
he stressed.
Assumptions of the amendment
The Sejm passed an amendment to the law on the Supreme Court on January 13, rejecting all opposition amendments. According to the authors, PiS deputies, the law should fulfill an important “milestone” for the European Commission to release money for the national reconstruction plan.
According to the amendment disciplinary and immunity cases of judges would be settled by the Supreme Administrative Court, and not – as now – the Chamber of Professional Responsibility of the Supreme Court. Also, the NSA will take over competencies to decide immunity cases from judges of all courts. The amendment also provides for fundamental changes with regard to the so-called review of the independence and impartiality of the judge, which would also be partly dealt with by the Supreme Administrative Court.
On January 20, President Andrzej Duda said he was calmly awaiting the outcome of parliament’s work on amending the Supreme Court law. Then I will discuss it in detail,” he said. He also recalled that it was not a presidential project, but a government project.
I am not the host of this bill. Also, in accordance with the applicable regulations, I do not even have the possibility to make changes to it at the stage of parliamentary work, only the applicant and parliamentarians are entitled to it
– reminded the president on TVP.
As he added, he calmly awaited the outcome of parliament’s work.
When the bill hits my desk, I’ll lean over it in detail
he pointed it out.
Earlier, the president announced, among other things, that he would not agree to solutions that would undermine the constitutional system and that he would not allow any legal act to be introduced into the Polish legal system that would undermine judicial appointments or enable anyone to verify these.
