According to Sebastian Kaleta, Deputy Minister of Justice, who was present today on TV wPolsce.pl, the draft amendment to the Supreme Court Act submitted by the government will not receive support from Solidarna Polska. The MPs will vote against the amendment if it passes without amendment.

This law violates the constitution and creates a huge risk of paralysis of the judiciary. It’s not about paralyzing our actions. The reform plans of Solidarna Polska, in which we predicted uprisings (judicial cabinets – ed.) have been blocked. Even in the United Right camp we were attacked for these plans, but unfortunately we were proved right. In this wording, this law will not be accepted by “Solidarity Poland”, which means we will vote against it. I hope that our camp will think again and that we will return to a radical and courageous reform of the judiciary. Today we see what happens to our state when reforms are implemented with half measures or when we try to negotiate with people who represent an anti-state attitude

The KRS and the Supreme Court are the institutions most aware of the tools needed by the “rebels”, i.e. judges with several children from “Iustitia”, who want to destabilize the judiciary. Unfortunately, this law gives these judges these tools. (…) Judges of “Iustitia” want to assess the status of a judge at every stage of the proceedings and in every case. We’ve had examples where a group of a dozen judges tried to undermine the status of other judges, but they faced disciplinary action. Thus, other judges became aware of the illegality of undermining the status of judges. Unfortunately, this law (the amendment to the Supreme Court – ed.) legalizes such actions and can lead to bad consequences for the Polish judiciary

It should be remembered that this whole situation is not the result of the reforms of the Ministry of Justice or “Solidarity Poland”. The concept of reform of the Supreme Court and the National Judicial Council was vetoed by the president and then adopted in a watered-down form. This was done in the name of compromise with the judiciary. The problem is that this environment does not want any compromise, but only full, non-democratic power for itself. Today we are at the stage where attempts are being made to deny the nominations of President Andrzej Duda
