The belief that there will be a cross-party compromise on the draft amendment of the law on the Supreme Court, including within the ruling coalition, but also within the opposition, was expressed on Friday by the deputy head of the Ministry of Internal Affairs and Administration, Paweł Szefernaker .

The deputy head of the Ministry of Interior and Administration was asked on Polish Radio Koszalin about talks announced Friday between Prime Minister Mateusz Morawiecki and Justice Minister, Solidarity Poland head Zbigniew Ziobro on the draft amendments to the Supreme Court law, the approval of which should enable Poland to disburse funds from the FPO.

The deputy head of the Ministry of Internal Affairs and Administration was asked if he imagined a situation where not Solidarna Polska deputies, but some opposition deputies voted in favor of the draft amendment to the Supreme Court Act and that these solutions would be adopted in January are accepted. .

Draft amendment to Supreme Court law
On Dec. 13, PiS deputies submitted to the Sejm a draft amendment to the Supreme Court law, which the authors say should mark a major milestone for the European Commission to unblock funds from the KPO. The project’s assumptions were negotiated during the talks of EU Minister Szymon Szynkowski, also known as Sęk, in Brussels.
Two days after the draft was submitted, President Andrzej Duda stated that he had neither participated in its preparation nor been consulted. He called for calm and constructive parliamentary work on the bill. At the same time, he stressed that he would not agree to solutions that undermine the constitutional system and would not allow any legal act to be introduced into the Polish legal system that would undermine judicial appointments or allow anyone to verify them.
The Sejm was due to consider the bill before Christmas, but it was taken off the agenda. His consultations and work on the design of two legislative teams: presidential and government teams were announced.
According to the draft, disciplinary and immunity cases of judges will be decided by the Supreme Administrative Court, and not by the Chamber of Professional Responsibility of the Supreme Court, as is currently the case. The proposed amendment also extends the scope of the so-called test of independence and impartiality of the judge, which can be initiated not only by the litigant, but also ex officio by the court itself. The draft also supplements the exams during the test, with the starting point being the appointment of a judge “under the law”.
What do the opposition and Solidarna Polska say about the project?
Opposition clubs already announced last week that they are ready to work on the project. According to PAP information, the opposition wants to table amendments to the draft, which would include entrusting disciplinary cases of judges to the criminal chamber of the Supreme Court, reinstating the former selection procedure of the National Judicial Council and abolishing the amendment to the law on the Organization of the Common Courts and the Law on the Supreme Court, adopted on December 20, 2019. It introduced the disciplinary liability of judges for acts or omissions that may prevent or significantly impede the functioning of the judiciary, for acts that impair the effectiveness of the calling into question the appointment of a judge, and for public activities inconsistent with the principles of the independence of courts and judges.
Last week, Zbigniew Ziobro stated that Solidarna Polska expects the prime minister to meet and “indicate a way out of the new political situation related to the submission of a draft amendment to the law to the Supreme Court”. Earlier, Ziobro announced that the Ministry of Justice and Solidarna Polska would not accept the Supreme Court’s draft in the form submitted by PiS. According to him, the proposed rules are in many places contrary to the constitution and are a serious violation of Polish sovereignty.
