There are no indications that Solidarna Polska will leave the United Right government and coalition, Prime Minister Michał Wójcik (SP) said on Tuesday, referring to the draft amendment to the Supreme Court law. He pointed out that the red line in any discussion is the issue of sovereignty.

– said Wójcik on TVN24, when asked about the conflict in the ruling camp over the draft amendment to the Supreme Court law submitted by PiS.

When asked if the draft amendment to the law on the Supreme Court, agreed with Brussels by European Union Minister Szymon Szynkowski vel Sęk – if adopted – is not such a red line, he replied that “this is chaos, anarchy, destruction of the state and this is crossing the red line” because – as he said – undermining the status of judges by the judges themselves is very dangerous.
When questioned, he admitted that “a scenario would probably be written” in which Solidarna Polska would leave the government and the United Right, if – as the moderator asked – PiS passed this project through the Sejm and bypassed the SP’s votes. Wójcik ruled that it was right for the draft to be blocked in this form, ie removed from the agenda of the Sejm.

He said that just before the bill was presented to the Sejm by PiS deputies, there was an informal meeting of ministers in which he participated, in which the SP first expressed constitutional doubts – about undermining the status of judges.

He said that Solidarna Polska has said from the beginning that it would not sign such a project. He reported that in appeals courts, 35 percent of judgments were made by judges nominated by the National Court Register after 2018. In district courts, this percentage is 28 percent and 21 percent. in district courts – it’s 3 million judgments.

According to Wójcik, this project became “an orphan and a near-death project”. He argued that the alternative to the current United Right government is PO head Donald Tusk and, according to Wójcik, European Commission President Ursula von der Leyen supporting him, which is unfavorable for Poland.
He assured that as an independent group Solidarna Polska was “doing well”. He said he had not heard of any prime minister scenario currently emerging.
Draft amendment to Supreme Court law
Law and Justice MPs submitted to the Sejm a draft amendment to the Supreme Court law, which the authors say will complete a major milestone in the KPO case on Dec. 13. According to the draft, disciplinary and immunity cases of judges should be decided by the Supreme Administrative Court, and not by the Chamber of Professional Responsibility of the Supreme Court, as is currently the case. The proposed amendment also extends the scope of the so-called test of independence and impartiality of the judge, which can be initiated not only by the litigant, but also ex officio by the court itself. The draft also supplements the exams during the test, with the starting point being the appointment of a judge “under the law”.
Last Thursday, President Andrzej Duda stated that he had not participated in the preparation of the draft amendment to the Supreme Court law, nor had he been consulted. He called for calm and constructive parliamentary work on the bill. At the same time, he stressed that he would not agree to solutions that undermine the constitutional system and that he would not allow any legal act to be introduced into the Polish legal system that would undermine judicial appointments or allow anyone to verify them.
The bill was due to be considered in the Sejm before Christmas, but was dropped from the chamber’s agenda. His consultations and work on the design of two legislative teams: presidential and government teams were announced.
