““Gazeta Lubuska” and the i.pl portal reported that Robert Dowhan, a senator from Civic Platform, was sentenced to pay child support to his ex-wife. However, as of 2018, he sent transfers in which titles, instead of “child support”, wrote, for example, “A thief will always be a thief, and sz…and k…always sz…and k…!! !” or “payment for PLN-me”, for “sex holidays”, “sex trips”.

The senator’s ex-wife decided that the amounts transferred were not alimony. And if not, then there was a payment arrears. So she started the formal procedure to collect them through a bailiff. Robert Dowhan sued him, but he lost the case. He defended himself further and went to court, which stayed the execution pending trial, as the senator may have been right about money for children – despite descriptions that, for example, sex holidays

The daily wrote that the ex-wife started this formal procedure in early January 2022, and on April 12, 2022, Robert Dowhan – as Senator of the Republic of Poland – made an official statement during the Senate session addressed to the Minister of Justice and Prosecutor- General Zbigniew Ziobro. In it, he asked: Is it legal to enforce double alimony just because someone entered something other than “alimony” in the title of the transfer?
“Emotions, resentment, regret
The author of the article wrote that Robert Dowhan explained to her that he had asked the minister because his conversations with lawyers and the bailiff showed that it was a serious social problem. A legal situation that is not uncommon – and that he convinced himself that if you do not clearly describe the money transferred as alimony, there may be a presumption that it is money for a different purpose.
Robert Dowhan stated in an interview with me that he interprets these offensive transfer titles differently. He said they were brought in not by a senator questioning the secretary (according to Dowhan, these two cases are completely unrelated), but by a concerned father who believes the ex-wife is spending alimony contrary to their intended purpose, because on himself. He said his emotions wrote through him. Emotions, resentment, regret (…). That he had no other way to cry out. Those were moments of weakness. Extreme emotions for which he apologized in court…

There is a lawsuit pending with offensive titles in the background. The attorney representing the senator’s ex-wife indicates that in the event of any financial obligations being met, the title of transfer is important and should indicate the debt the payer is willing to pay (…) In the absence of such indication the creditor can credit the payment against any other debt.
The senator’s ex-wife says out loud today that she is mentally exhausted. “It has been years now. I am eight years after my divorce and I still feel insulted and humiliated by my ex-husband. He publicly cares for women’s rights but does not respect them himself and insults the mother of his children …
