#USA: rights denied

The U.S. Supreme Court overturned a famous 1973 decision by giving back to the federal states the power to regulate abortion, which consisted of nine members sentenced to life in prison and bent far to the right by Trump’s appointments. Karaca vs. WadeBy invoking the 14th Amendment of the American Constitution, she generalized the right to terminate a pregnancy to the entire population. In other words, top commentators of legality have stripped away the protection this right had, so nearly all Republican-run states would outlaw abortion and impose harsh sanctions on women who practice abortion. Logically, one might expect secret abortions to return, and with them desolation and death.

The aforementioned 14th Amendment serves to guarantee certain rights that are not expressly stated in the Magna Carta of the United States, but are “deeply rooted in history and tradition” or “implied in the concept of essential liberty” as established by Washington. v. Glucksberg decision in 1997. For example, the 14th Amendment, Brown v. Board of Education. It has likewise been used to protect LGTBI rights.

The issue of abortion is extremely sensitive as it is intertwined with the religious and moral beliefs of the citizen. What is certain is that permissiveness in this regard is openly supported by the majority in the United States (61 percent of Americans support it, according to a Pew Research poll), so that a once-right morality becomes a serious arbitrariness to at least suppress. only by legal arguments, skimming previous sentences to dictate a new sentence.

Once the norm has been consolidated over time—almost half a century after its creation—the struggle of those who legitimately oppose abortion must be confined to the realm of ethics and pedagogy. For example, it is legal for anti-abortion activists to try to deter women about to have abortions with aids that facilitate motherhood. Or does it even make sense for them to include this ban in their program to try to get a majority of Congress to reverse the current law?

Because the problem is that this decision by a group of saints opens the door to the reversal of all the moral clarity that the United States has experienced since proclaiming its Constitution in 1787. In short, the fate of a modern and inclusive society, which to this day has been the forerunner of a culture of tolerance, culturally and aesthetically as well as politically, is at stake. Without going any further, Hollywood has been an emotional teacher for many generations of audiences around the world.

In short, this run-in between American democracy and a distant setback—the US’ conflict with its own identity erupted when the system failed to prevent a paranoia like Trump from reaching the White House—shows that within us it is unresolved. It regulates the proper balance between judicial and legislative power, which in the USA represents popular sovereignty along with the president. A model institution in many ways, the US Supreme Court should never be used to suppress progress, but rather to expand advantages and rights. The long integration of black slaves into the national society, decided even in a racist-lost civil war, can no longer witness an oppressive regression that traps freedom in sacraments and homosexuals in closets.

This evidence also applies to Spain, where our Constitutional Court, discredited by the laziness of certain organizations and parties to it, is not applied to impose puritanical censorship over our uses and customs, but rather to positively protect our freedoms. protect us from excessive forces and protect us from arbitrariness.
