A 58-year-old man was sentenced to ten years in prison by the Alicante Court for sexually harassing a woman linked to a family friend and a four-year-old girl. The acts occurred after a group of friends’ daughter, then four, was taken to an address in Calp using the defendant’s mobile phone to arrange the visit.
The First Division court determined the defendant is responsible for multiple offenses: a primary offense of continued sexual abuse, carrying a five-year term, and a second offense involving child pornography production, which adds another five years to the sentence.
According to the court documents, on the afternoon of 17 September 2019, the accused engaged in sexual abuse by touching the minor while a family friend offered to take the girl for a walk around Calp as her mother worked nearby giving a manicure to a friend.
The final verdict states that the defendant took the girl home, undressed, placed clothing on her legs, and touched her vagina while recording the incident on a mobile phone.
The court notes additional incidents, including further inappropriate touching of the girl in a restaurant restroom where the girl’s father was employed.
Eventually, the minor’s parents filed a complaint with the Civil Guard on 30 September 2019, which led to the case being investigated.
At the outset of the case, the defendant admitted the facts and agreed with the narrative presented by the Prosecutor’s Office, a factor noted by the court in determining the outcome.
Beyond this confession, the sentence includes as further proof that the defendant’s phone contained a harassment video, the subject of another case, with additional videos being seized following his arrest.
In addition to the two prison terms, the sentence imposes ten years of probation and orders the defendant to pay 20,000 euros in damages to the minor’s parents.
