The complainant, aged 27, had gone to her workplace with a companion that night. They reportedly went to the terrace of the building where several participants were engaging with another woman.
According to the plaintiff, at one point she observed a man engaging in intercourse behind her while she faced away. Upon turning, she confronted him and learned that he was not wearing a condom. The accused supposedly offered protection but the woman refused, and, in her police statement, she said, “I don’t want you touching me because you ended up inside me without protection.”
Following a dispute, the two parted ways, and the woman left the scene with her friend. The man reportedly followed in a vehicle, continuing to speak with her in a pressure-filled manner and subjecting her to insults. The complainant reiterated that she had been penetrated without her consent and without condom use. There were concerns mentioned about potential transmission of an illness.
The next morning, the woman visited a health facility and reported the assault to medical staff. The regional police were alerted and arrived on site. Medical personnel conducted examinations, including gynecological assessment and forensic analysis. The National Police Family and Women’s Unit (UFAM) opened an investigation and re-recorded the victim’s account. She was identified by photo by the authorities.

The matter advanced to a Palma inquiry court where the defendant provided a statement weeks later as part of the investigation into the alleged sexual assault. He, who is 28 years old, rejected the allegations and described himself as attending an event that night with a sex-themed gathering involving about 15 to 20 people on the club terrace. He claimed that he approached the complainant only to discuss continuing a relationship, but she reportedly refused condom use unless he wore one. Upon his return with a condom, she supposedly rejected him. He maintained that he did not penetrate the complainant, and that there was no shouting or pursuit in the street. He also claimed to be a regular patron of the establishment and denied any misconduct.
Officials also collected statements from the club owner and other witnesses. Their accounts did not indicate any irregularity at the venue on that night.
