In the days following the crime, 17, 18 and 19 July, Penguin tried to get in touch with the friend in question to say something “very strong” to him. The defendant’s intent was to tell himself that he had killed Carolina Fumero and to seek help in hiding the body. The defendant also told him that “something would happen to me” today, so he would leave his car for her. But to questions from Jésica Hernández Peña, attorney at the Canary Institute for Equality (ICI), the witness said she did not know whether the only person involved was planning the sexist crime.

It was determined that one of the witnesses who testified was Fernando, Carolina’s friend and ex-partner. After a court in La Orotava convicted José Miguel Quintero of ill-treatment and ordered a restraining order, the woman lived in this man’s home for several days. She also admitted that she was a friend of the quintero. The witness noted that there were many couples issues between Carolina and José Miguel. He was also aware that, in the weeks before his death, the victim was living with Quintero, despite restraining orders.

“Carolina feared for her life; she thought she was going to kill her,” said one of the victim’s friends.

Fernando handed the letters he received from Carolina to another man who testified at the second trial, who was Carolina’s friend and was her daughter’s godfather. This friendship lasted for many years. He also knew that José Miguel and Carolina were not having a good time in their relationship because the victim had told him so. It was this neighbor who accompanied her to report to the court, and Civil Guard agents called her cell phone when they could not directly locate the abused woman.

The victim asked another friend to look for letters in which she wrote about her feelings if something serious happened to her.

This witness admitted that he had asked the affected person not to return to live with José Miguel, as the incident could “go further”. According to her testimony, Carolina decided to return to Quintero because she allegedly threatened to harm a sister and even her own daughter. He was aware that the victim was writing letters and in some cases told him to look for such texts if something serious happened to him.

The man in question, who has a partner he never thought of living with Karolina, stated that he saw the murdered person almost every day. He noted that José Miguel was “quite jealous” of this friendship. He stated that to meet him, the victim took advantage of moments where Quintero would take a shower, such as to escape and go to the car with him.

The victim’s daughter assured him that her mother avoided telling her about her attacks and relationship problems with Quintero. In fact, it was the young woman’s father who explained to her that her mother was injured and that a court in La Orotava had convicted José Miguel for such acts. Carolina’s daughter believes that her mother does not want her to see her with bruises or involve her in her bad experiences.

The witness stated that she was on good terms with her mother and that when she went to live with her boyfriend, her mother was “looking for life” to buy her food and help her as much as she could. He also knew that his mother wrote letters, “like a kind of diary, but on loose paper.” She learned this custom from her aunt, who started to express her feelings in this way when she grew up.

Jonay Martin was a friend Penguin. He didn’t know about it since November or October 2019, he told jurors. But after the events, in the early hours of Sunday, on July 18, 2020, Quintero invited him to have a few beers together at his house. When Jonay left home, he went to a Repsol gas station bar where he drank “croissants and whiskey.” From then on, she told many people, including a sister and mother, about what she saw at José Miguel’s house and the problem she was in. This witness is being investigated at La Orotava Court as the alleged perpetrator of concealing a murder. After learning of the case, Jonay commented at the hearing, “You should see yourself in this situation; I lost my job and I lost everything.”

The Monday after the crime, Quintero met him at a gas station bar. And he was there today when the accused said he had put the body in a septic tank in the garage.
