Labor inspector sanctions Ryanair for failing to pay SMI to some cabin crew

Labor Inspector approved Ryanair and Crewlink and Workforce agencies to hire hourly cabin crew (TCP) and avoid paying the Minimum Interprofessional Wage (SMI). A fine that can range from 751 to 7,500 euros.

This was stated this Thursday by USO Sector Aéreo, which filed a complaint about these practices in 2022, emphasizing that Ryanair “continues to use illegal recruitment agencies” despite the decision of the National Court, ignoring judicial explanations.

The Labor Inspection Order states that the workers were “hired on a full-time basis” and that wages must comply with the SMI for the year in question, as there is no valid collective agreement.

However, in the contracts reported by the USO, the payment of an amount per “scheduled block flight hour” was determined as wages, although there were other cases where an amount was determined as a fixed annual salary.

The Labor Inspector found that in almost all of Ryanair’s employment contracts with Madrid-based TCP, The annual gross salary is set not to exceed 9,000 euros, and the pay per flight hour varies between 6.68 euros and 16.22 euros. depending on the company you hire. However, the salary received in the first payroll of these contracts is lower than the SMI.

The audit found that “since these are full-time employees, regardless of whether part of their remuneration is directly linked to flight hours actually performed, the company has an obligation to ensure that at least the following amount is received on a monthly basis”: “The amount established for each year as the minimum interprofessional salary” .
