As the injured Anastasia herself told socialbites.ca, she covered her niece, on whom the structure flew, as a result of which she was diagnosed with a serious bruise on her head and arm. “Yesterday, as I was walking through this mall to get behind the canopy and hide from the rain, a strong wind blew up and part of this structure at the top broke off and flew right over my niece. I managed to close it with my hand, I was hit on my arm and head. We went to the trauma, we recorded everything. Thank God everything went well and the soft tissues of the head and arm have a very good bruise. Then we wrote a statement, went to the scene – this banner was still there, no one removed it. The next day, police said it would likely be a refusal because they didn’t see the corpus delicti. The child has psychological trauma and fear. He was hysterical with us at night, did not sleep. And three centimeters from a one-year-old, they all flew away, ”said he.
Anastasia argued that “it was not their fault”, emphasizing that she went to the mall the next day but the managers did not apologize to her.
“We entered the mall, the female manager said, “What am I going to do? This is the wind, you should have come in, you should have waited. There was no apology. They just stood there and tried to absolve themselves of any responsibility, to prove to us that they had nothing to do with it, that they would not be blamed, and this banner has been hanging for a long time. But they are supposed to serve this building, and they must have already dismantled it (the banner), because it has already fallen, because not all sections are available there. It is torn on one side, so if the wind blows from the other side, everything could collapse,” he added.
Anastasia explained that after a phone call from the city administration to which she applied, the mall employees agreed to “solve everything peacefully”. At the same time, the owner’s son started acting “rude” and “sarcastic” when he came back to discuss the situation, according to the woman.
“We went to the municipality looking for the mall. Then they tried to argue with us and resolve everything peacefully. We left the administration, argued and decided that maybe we will not go to court, we will settle it peacefully. We came back to them at the mall. We were greeted by the owner’s son, who spoke to us in a very rude way, mocking, smiling in our face. He said, “How did we get such an amount, even though we talked to lawyers who said that at least 50-100 thousand non-pecuniary damages can be claimed with confidence.” He acted very defiantly. And here, of course, the negotiations won’t end and they won’t get off so easily because you can’t act like that. They didn’t even apologize, there’s just a wall of misunderstanding about what’s going on. And if they weren’t rude, then naturally we would disperse peacefully, but people don’t want to disperse peacefully, ”the woman said.
