CNMC may sanction Ecoembes for possible abuse of dominant position

this National Markets and Competition Commission (CNMC) Launches disciplinary proceedings against Ecoembes for “allegedly possible behavior” abuse of dominant position in the market”, as reported by the regulatory agency in a statement Wednesday.

Specifically, these are practices contrary to the Law on the Protection of Competition (LDC) and the Treaty on the Functioning of the European Union (TFEU).

Since 2004, CNMC has been investigating: “The processing of an arbitrarily conducted auction procedure that does not guarantee the transparency, traceability and integrity of submitted bids”.

In addition, the regulatory agency monitors “the establishment of access barriers to participate in and therefore qualify for the said tenders”, “obstacles that cannot be justified for technical, environmental or economic reasons”.

This new investigation lies in a complaint filed by PET Compañía para su Reciclado, SAU against Ecoembes, and in confidential information conducted by the Competition Directorate.

Within the framework of this confidential information, CNMC inspected the headquarters of Ecoembes and other recycling companies in December 2021 and made numerous information requests to different market operators.

Ecoembes, for his part, gave EFE a note where they remembered: The complaint was “made by a single recycling company out of more than 380 companies. Certified by Ecoembes for the correct recycling of local packaging in Spain”.

The main manager of plastic packaging in Spain ensures that “all Ecoembes approval, decision and auction procedures strictly comply with antitrust legislation and are publicly documented on the Ecoembes website to guarantee accessibility, free association and market competition.

Therefore, “Ecoembes is fully available to both the investigators and the CNMC itself to resolve any issue and fulfill any information requests they may need in the process.”
