This was approved by the Government at the last Cabinet in 2022, and the regulatory change awaits publication in the Official State Gazette (BOE) to take effect.

Until now, the worker who was affected by a temporary disability had a period. three days, counts from the moment the doctor is discharged to deliver the report to your company. Failure to submit documents on time was grounds for punishment by management, which could go as far as dismissal.

With the new regulations coming into effect in the next few days, the worker will only receive one copy of the sick leave when he goes to the doctor. According to the government, after the ministerial meeting, Social Security removes both “the second copy and the worker’s obligation to deliver this copy to the company, management body or reciprocal.” The idea is to eliminate bureaucracy and procedures for workers and the administration itself, through telematic and automated channels, which now undertakes these procedures.

Submitting medical leave reports can be a headache for workers, especially if the reason for their leave is particularly disabling and it is complicated to submit documents within a three-day period. The employee may appoint relatives, friends, or a legal representative to submit the report on his or her behalf, but lack of knowledge of the legislation has often made such efforts difficult.

It also limits the possibilities for some companies to use this kind of remorse to fire workers who, despite being on leave from a healthcare professional, fail to meet official deadlines. Until now, regulations provided for the possibility of sanctioning the worker, as the company needed permission to process the situation and save on social benefits.

Now this whole process will be automated and the worker with temporary disability will no longer have to worry about it. Also, if your leave is extended due to disability and you need to renew your leave. So far, I’ve had to resubmit all documents to the company, and after the legal change, Social Security will be responsible for notifying the company at each renewal.
