Germany regulates situations where search engines need to delete information

Germany’s Federal Supreme Court has ruled that search engines should only remove personal information from search results if it is not accurate. TASS.

It follows from the decision that the information should be deleted only if the user makes such a request and his claims are clearly justified.

The precedent followed a lawsuit by a financial advisory couple who found negative reviews of their business on Google’s search engine to be unfounded. Photographs of the plaintiff were added to the negative posts, and both the text and the photograph were requested to be removed.

The court decided to remove only the images that violated privacy. According to its decision, negative responses based on a subjective assessment, in which personal data are not disclosed, are not unlawful.

It was noted that the plaintiffs did not present the necessary evidence that the information contained in the reviews was unreliable.
