The European Court of Justice has ruled that Amazon can be held responsible for the distribution of counterfeit products of the Christian Louboutin brand. writes about it WWD.
The preliminary ruling, published on 22 December, stated that Amazon’s actions could be considered as the use of a trademark registered in the EU by Christian Louboutin if the site visitor had the impression that the retailer was distributing the French brand shoes itself.
Amazon may be held liable if it fails to distinguish between its own listings and third-party listings and offers support to third-party sellers through services such as storage and shipping.
The French luxury shoe maker interpreted the decision as a way to “better protect the brand.” According to Alexis Muro, CEO of Christian Louboutin, this is “a win for any brand that advocates its know-how”.
The French luxury shoe brand filed two complaints against Amazon in 2019, one in the Luxembourg District Court and the other in the Brussels Companies Court. So he tried to limit the use of his own branded red soles and to stop the sale of fakes on Amazon.
