The issue of payment of the thirteenth salary depends entirely on the employer’s decision. In an interview with the agency “Hit the primer” BGP Case labor law partner Anna Ivanova explained to whom this payment can be accrued and whether it is possible to regulate it by law.
According to the lawyer, in many companies the thirteenth salary is paid: in some it replaces New Year’s gifts, in some it serves as indexing, and in others this right can be guaranteed by collective agreement. However, it is important to remember that this payment is not mandatory and only employees who receive a decision from their employer can rely on it.
Ivanova also recommends adding a thirteenth salary requirement to the wage rules. For example, you can state that it replaces annual indexing or is tied to the company’s revenue.
“Since the provision on bonuses in the Labor Code is regulated in a rather abstract way, various proposals will help the employer in the event of a dispute in court if the employee applies for payment or indexation,” he added.
