With a high probability, the court will declare the “queen of marathons” Elena Blinovskaya bankrupt and conduct a procedure for the sale of her property. This opinion was expressed in an interview with socialbites.ca by Svetlana Tarnopolskaya, partner of the Yukov and Partners Bar Association.
“It is quite possible to declare bankruptcy and introduce a procedure for the sale of property. Especially if the purpose of such bankruptcy, as stated, is to sell property, in particular, to pay off tax debts. The court, of course, will not allow the debtor to appoint “his” candidate for the financial manager in such a bankruptcy, Tarnopolskaya noted.
He said that it is optimal to appoint a financial manager from the list of self-regulatory organizations recommended by the Federal Tax Service.
Tarnopolskaya called for taking into account that even if such a scenario happens, the sale of real estate seized under criminal proceedings during the bankruptcy proceedings is not an easy task. However, the lawyer concluded that such a chance exists if the Federal Tax Service supports this idea in court.
On August 19, the Moscow Arbitration Court postponed the consideration of Blinovskaya’s bankruptcy application until November, writes RIA Novosti. During the meeting, the representative of the “marathon queen” Ivan Morozov announced that he was ready to sell another apartment worth about 90 million rubles to pay off debts to the tax authorities. According to him, such a transaction can be completed by a letter of credit from a bank, where the money in the account will be frozen until the buyer takes possession. Morozov suggested opening a letter of credit for a tax account and lifting the seizure of real estate by the investigator.
