The State Duma proposed amendments to the Tax Code, cancel VAT on expired products distributed to charities for retail chains. The newspaper, on Wednesday, June 28, writes that the related bill was developed by Liberal Democrat Party deputies. “News”.
“At the stage of retail trade and consumption, the annual loss of food products in the Russian Federation is about a fifth of their production.
The explanatory note states that this phenomenon is caused by various factors, from natural and climatic and weather conditions to man, expressed in violation of storage conditions ”.
The parliamentarians added that attempts to address this problem have been “made regularly, but so far”. According to deputies, the unrequited transfer of such goods to the population can be an effective measure, but this is unprofitable for retail chains, since they now only have the right not to pay VAT on expired, discarded products.
“The bill aims to exclude expired food products from the list of tax objects in the event of their unrequited transfer to third parties, allowing them to be exempt from VAT.
Thus, the problem of the subsequent processing of this category of goods and their scarcity in certain social groups will be solved simultaneously.”
The authors of the initiative recommend removing alcohol from the list of goods that can be transferred to the population, children and diet food.
The press service of the LDPR fraction reported that the bill was sent to the Russian government for review. Amendments are ready to be supported in the relevant committees of the State Duma.
In September 2022, the head of the Ministry of Industry and Trade, Denis Manturov, said that the Ministry of Industry and Trade and the Ministry of Finance are working on tax conditions for food sharing. TASS.
In July, Deputy Minister of Industry and Trade Viktor Yevtukhov said that the tax burden for retail chains should be equalized if food is destroyed or donated to charity.
According to current regulations, when disposing of unsold goods, the seller receives input VAT withholding, but transferring the same goods to charity results in the loss of the right to VAT deduction.
Therefore, Yevtukhov explained that it is more profitable to throw away or dispose of an unsold but completely usable product than simply donating it to charity for free.
