The Federal Antimonopoly Service of the Russian Federation (FAS) is seeking in the Supreme Court (SC) the right to control the competitive distribution of budget subsidies. newspaper reports “Kommersant”.

The newspaper notes that the dispute concerns the allocation of funds from the Omsk budget for the overhaul of houses on a competitive basis. Earlier, the regional Federal Antimonopoly Service, after an audit, came to the conclusion that when choosing a company, the Omsk authorities violated Art. 17 of the law on the protection of competition.

According to lawyers, anti-monopoly control over the distribution of subsidies in competition is necessary, since we are talking about trillions of rubles a year and high risks of corruption.

As the publication explains, the Supreme Court of the Russian Federation will have to determine the powers of the Federal Antimonopoly Service to control the procedures for distributing subsidies from the budget, and the compliance that the supervisory body wants to audit.

Experts believe that this issue is “extremely topical, given the large number of people seeking budget funding.”

According to the anti-monopoly lawyer Natalya Pantyukhina, the financial control of the Treasury or the Accounts Chamber is not enough, because they do not control the conditions of competition for subsidies, but only deal with agreements according to their results, whereas the FAS has the right. issuing orders to return illegally received subsidies to the budget or to enforce new tenders.
