HR consultant Roman Gubanov said that the employer has the right to refuse to give the employee leave in case of dismissal, and this condition is spelled out in the concluded employment contract. It has been reported RT.
According to the expert, in such a situation everything depends on the holiday schedules.
For example, if an employee has previously agreed on a vacation date with management, no problems should arise.
“If the employee did not discuss this issue and did not spend his days off during work, the manager has the right to decide for himself whether to ban the holiday or not,” he noted.
A refusal may come if the employment contract contains a provision that the worker must work for two weeks without a vacation before leaving the company.
“There is another good reason why an employee does not have the right to leave – dismissal for not performing duties,” Gubanov explained.
