60-year-old Sergey Zaitsev bought a 2020 type car for 1 million 60 thousand rubles in March last year. Soon after, the driver noticed a Check Engine indicator light on the vehicle’s instrument cluster and the car’s engine began to fail.
The owner of XRay turned to specialists in the diagnosis of electronic systems and control units, which confirmed the engine malfunction. The man went to the car’s dealer to request a preliminary hearing to terminate the sale and purchase contract and refund the car’s price, but was ignored.
After a second technical inspection, the court was convinced that the car was defective and sided with Zaitsev. The car dealer was charged with the cost of the car, fines, fines, non-pecuniary damage and court costs (over 2.8 million rubles in total). The seller appealed against this decision, but the civil chamber of the Kemerovo District Court upheld the decision.
