Federation nationals will be able to determine independently the amount of the fine for toll road violators. The money collected goes to the local budgets, follows from the account of the Ministry of Transport, to which Kommersant refers.
The bill drawn up by the department amends art. 12.21.4 of the Code of Administrative Offenses, which establishes a fine for driving on toll roads without payment. Now it is 1.5 thousand rubles. for cars and 5000 rubles for trucks and buses. The Ministry of Transport proposes to impose the fine only on federal roads and the regions will have to determine their own sanctions. The Ministry of Transport, Public Works and Water Management explains the need for change through “law enforcement practice analysis”.
If the changes are passed, new sanctions are likely to await users of the Moscow high-speed diameter, the northern understudy of Kutuzovsky Prospekt, future toll roads of the Moscow region and other regional facilities.
Article 12.21.4 was introduced at the end of 2020 to combat motorists who do not pay toll on toll roads. In most cases where there is an unfettered free-flow payment system (travel without barriers). Over 1 million such fines have been issued throughout the system’s existence.
Another curious point of the bill: after receiving an erroneous fine from the camera for not paying the fare, the presumption of innocence does not apply – the car owner will have to prove himself that he has not committed any violations.
