The new technical inspection law says that if the car has passed the inspection, the traffic police will not be able to check the technical condition on the road, “except in cases of visual detection” of malfunctions. In accordance with Article 15 of the Federal Law of August 3, 2018 No. 170-FZ “On the Technical Inspection of Vehicles and on Amendments to Certain Legislative Acts of the Russian Federation”, if a state technical check has been carried out on the vehicle in the has been issued in the form of a roadworthiness test and a diagnosis card, containing a conclusion on the conformity of the vehicle with the mandatory vehicle safety requirements, checking the technical condition of the vehicle in the form of state control (supervision) of road safety not executedexcept in cases of visual detection of signs of a technical failure threatening road safety.
At the same time, the Traffic Police Regulation of the Ministry of Internal Affairs of Russia, approved by Decree of the President of the Russian Federation of June 15, 1998 No. 711, imposes on the State Traffic Inspectorate the responsibility of exercising state control and supervision of compliance with regulatory legal acts in the field of road safety, which lay down requirements, including for the design and technical condition of motor vehicles in use, their trailers and their additional equipment, as well as changes in the design of motor vehicles and trailers that are registered with the State Traffic Inspectorate. These powers can be exercised, for example, in the process of traffic enforcement.

- technical failures associated with a violation of the integrity of the vehicle structure;
- non-illuminated (absent) headlights and taillights (at night or when visibility is insufficient);
- inactive windshield wiper on driver’s side in rain or snowfall;
- inappropriate design of the vehicle, the color of external lighting equipment;
- improper vehicle design, wheel and tire dimensions;
- installed additional items and coatings that limit the view from the driver’s seat.
At the same time, the criterion on the basis of which the traffic police officer makes a decision to check the technical condition of the vehicle is the creation of a potential threat to road safety, that is, the risk of a traffic accident.
