The car, State Duma Deputy Sergei Mironov, crashed into a courier with a bicycle at a pedestrian crossing in the center of Moscow. After the accident, Mironov’s driver twisted the numbers and the flasher out of the car and placed them in the trunk. Sergei Radko, an automobile lawyer from the Freedom of Choice public movement, in an interview with socialbites.ca, stated that the fact of the skewed numbers will not affect the determination of the culprit of the accident, but the driver of the car is most likely to be found guilty in this case.

“As far as I know, there is some kind of instruction regarding bending of plates and flashing lights, although it has nothing to do with the rules of the road. It distorts the numbers and says nothing about the flasher’s guilt or innocence in the accident. Here it will be determined whose particular violation led to the collision. Either the courier did not get off the bike and he moved too fast or the driver did not give way to him at the crosswalk. In judicial practice, there is a fairly obvious interpretation: if a driver knocks over a cyclist, scooter or just a pedestrian at a crosswalk, then, as a rule, he is always guilty. This case, although I exclude that the blame may be placed on the cyclist, ”says the expert.

Radko noted that according to the rules of the road, a cyclist must dismount at a pedestrian crossing. But this does not exclude the possibility that the driver will follow the road more closely in this place.

“There is a very interesting area for experts to work here, because if a cyclist were moving on foot, his average speed would be 4-5 km/h. And the driver who could detect this danger would be able to react in a timely manner. On the bike it seems much faster and maybe the driver has a He didn’t have the technical ability to avoid a collision. But in any case, this is a pedestrian crossing, here the driver should have been more careful, so we can talk about his fault. Because a pedestrian at the same speed can be without a bike but can run. And this is due to the driver’s obligation to give way, or if he hasn’t done so does not absolve you from liability,” the automobile lawyer added.

Formerly Sergei Mironov approvedHe was in the passenger seat of the car at the time of the accident. He didn’t see the fact of the collision because he was working with the documentation.

“As soon as this happened, the driver got off, saw that the cyclist was alive and his leg was injured. When I was informed about this, I asked to call the ambulance and traffic police. We were waiting for these and others to arrive,” Mironov said.
