Autocriminalist Shelkov warns of fraud when selling cars on installments

When issuing a contract of sale (DKP) for a car in simple written form, it is necessary to describe in detail the calculation procedure, indicate the actual value of the car and not accept installment payments. Maxim Shelkov, head of the avtocriminal expert center, told socialbites.ca that this would eliminate the possibility of committing fraudulent acts.

According to him, it is necessary to specify in the contract the procedure for receiving and transferring the car, and not to accept payment in installments at the time of sale.

“There are many fraudulent schemes for deferred payments. For example, a buyer offers to divide the payment for a car into several installments. And if he stops paying, it is very difficult to get the car back from him, because there is no criminal element in it, it will no longer be possible to report a car theft,” Shelkov warned.

If payments are made non-cash, for example, if the car is given to the husband, then in order to avoid claims, it is necessary to indicate in the contract the number of the account or card to which the money was transferred. and the money for this is transferred from the card of the spouse indicated by the addressee. Shelkov noted that legally the spouses are different persons, and in the future, the seller from the cardholder, who will declare that the money was transferred and the car was given to another person, can be accused of unjust enrichment.

He argued that in such a case, it would take a long time to file a lawsuit within the framework of civil law relations.
