State Duma cancels overload fines for drivers, but left to transport owners

In the third reading, the State Duma passed a bill that abolishes the liability of drivers who exceed the dimensions of a truck or overweight without special permission, informs TASS.

12.21.1 of the Code of Administrative Offenses of the Russian Federation. According to the changes made in the article, the responsibility for violation of the rules regarding the movement of heavy and (or) large-sized vehicles rests solely with the vehicle owner. Drivers and other persons responsible for transportation are excluded from the list.

The bill also reduces the maximum fine under this article from 500 thousand rubles to 400 thousand rubles, such liability is provided for exceeding the dimensions of the truck by more than 50 cm or exceeding the permissible weight by more than 50%.

In 2019, the Constitutional Court of the Russian Federation ruled that a driver drives a truck on the basis of an employment contract with the owner and does not receive the right to own a vehicle, thus violating the requirements of the transport law. The risks of the goods still belong to the employer.
