In Russia, drivers will be held responsible for driving under the influence of drugs that are not related to ethyl alcohol, narcotic drugs and psychotropic substances, but that may impair their attention and reaction. This is due to the draft law prepared by the Ministry of Internal Affairs of Russia. published on the federal portal of projects of normative legal acts.

The bill proposes changing the note to Article 12.8 of the Code of Administrative Offenses (“Driving by a drunk driver”). The new edition introduces “a ban on the use of narcotic drugs and analogues of psychotropic substances or potentially dangerous new psychoactive substances.”

The document was developed to fill a gap in the legislation in force at the end of November. clarified Constitutional Court referred to in the explanatory note. Later, in the Yamalo-Nenets Autonomous Okrug, it was found that (gabapentin and nimesulide) may have an effect on impaired consciousness and movement coordination in drivers, but alcohol intoxication was not detected.

Since the publication of the Constitutional Court decision, if a driver’s blood or urine contains a narcotic substance not included in the list of psychotropic or narcotic substances, it is impossible to be held responsible for drunk driving or refusing to drive. Although it worsens attention and reaction, it should be examined. In particular, we are talking about phenazepam, phenibut, gabapentin, some antidepressants and other drugs.
