The State Duma plans to resolve the issue of deprivation of drivers’ right to take medication at the spring session on this publication “Ascension”. said Alexei Kurin, Deputy Chairman of the State Duma Health Committee.
According to Kurinny, it is necessary to make a list of drugs that affect the reaction and attention. He noted that the Ministry of Health should decide which drugs and in what dosage would be safe for drivers.
“Antidepressants are different. Some really cause drowsiness, inhibit the reaction, some do not. I do not exclude that the dosage will affect it. The Ministry of Health should decide for itself. I think this problem will be resolved in the next session. […] “The list should be comprehensive, understandable, closed, and no comment should be made, even at the court level,” he said.
Last month, the Constitutional Court (AYM) after case law with one of the drivers prohibited to punish drivers if they take drugs that worsen attention and reaction, not belonging to ethyl alcohol, narcotic drugs and psychotropic substances.
At the end of December at the Ministry of Interior suggested Changes in art. 12.8 of the Administrative Offenses Act to fill a gap in the current legislation. The amendments provide for sanctions in the form of deprivation of rights and a fine of 30,000 rubles for drivers whose bodies contain the corresponding substances from the drug composition.
Since the publication of the Constitutional Court decision, a driver cannot be held responsible for drunk driving or refusing to take a test if his blood or urine contains a drug that is not on the list of psychotropic or narcotic substances (despite the fact that these drugs can impair attention and reaction). We are talking about phenazepam, phenibut, gabapentin and other drugs.
