“The driving of a vehicle by a driver on the basis of an employment contract with the owner (owner) of the vehicle, and therefore under his direct control, does not in itself mean that ownership rights in the vehicle are transferred to the driver” , reminded the court again.
In the case of violation of traffic rules, it is considered that the employer has not ensured proper control over his employee, and therefore must be held liable in legal relations with the state.
“The use of a vehicle by an employee is identical to the use of a vehicle by an employer, Part 2 of Article 2.6.1 of the Code of Administrative Offenses of the Russian Federation does not contradict the Constitution of Russia, any other interpretation of it is precluded in law enforcement practice,” – the Constitutional Court has resolved all disagreements.
