It is no longer possible to confiscate a driver’s license and impose a fine of 30,000 rubles on a driver whose body contains traces of drugs not related to psychotropic drugs or narcotics. This decision was made by the Constitutional Court of the Russian Federation.
Previously, such a driver was equated with being behind the wheel in a state of alcohol or drug intoxication, if a certain drug was found in the blood or urine during the examination.
Now the use of phenazepam, phenibut, gabapentin and some other drugs has been effectively legalized.
It is emphasized that the ban imposed by the Constitutional Court is temporary and that the State Duma is obliged to close the identified gap “immediately”, but the deadlines have not yet been specified.
